Parliamentary Review of the Anti-terrorism Act

The Anti-terrorism Act (ATA) is one of several pieces of legislation that forms the Government of Canada's overall anti-terrorism strategy. It takes aim at terrorist organizations and assists the Government of Canada to meet the extraordinary challenges presented by terrorism. The legislation is intended to protect the safety, security and fundamental rights of Canadians. It contains numerous safeguards, which include an important requirement that Parliament comprehensively review the provisions and operation of the ATA after three years.

Section 145 of the ATA requires that a committee or committees of Parliament begin a "comprehensive review of the provisions and operation of the Act", within three years from the date that the Act received Royal Assent, which was December 18, 2001. A motion was adopted by the House of Commons on December 9, 2004 authorizing the Standing Committee on Justice, Human Rights, Public Safety and Emergency Preparedness to begin a review of the ATA. Its Subcommittee on Public Safety and National Security began its review in February 2005. The Senate adopted a similar motion on December 13, 2004, establishing a Special Committee to undertake a separate review.

The dissolution of the 38th Parliament on November 30, 2005, ended the work of the Parliamentary review committees. The 39th Parliament established committees to continue the review of the ATA.

Upon receipt of a report from a Parliamentary committee, a Government response must be tabled in Parliament within 120 days for a House report and 150 days for a Senate report.

Please note that two of the Criminal Code provisions enacted by the ATA, the investigative hearing and recognizance with conditions (know as the preventive arrest provision) powers are scheduled to sunset in early 2007. These sunsetted provisions are not affected by the dissolution of Parliament nor the timing of the Parliamentary review.
