Upon reading a Notice of Motion dated the 8th day of December 1995, the Affidavit of Donna June Charron sworn the 8th day of December 1995 and exhibits thereto, and upon reading the submissions of counsel for the Applicant all filed, it is ordered by consent as follows:

1. The appeal of the Respondent Carrie Somerton pursuant to s. 31 of the Public Service Employment Act be referred back to the said Appeal Board, and that the said Appeal Board be and is hereby directed to dismiss the said appeal.

2. There be no Order as to the costs of the Originating Notice of Motion dated the 8th day of October 1993.

3. There be no Order as to costs of this motion.
