TBS Organization - Legal Services


The TBS Legal Services is composed of Department of Justice lawyers and an administrative support team of TBS employees.

  • It provides legal advice to the Treasury Board and the President with respect to their powers and duties. 
  • It supports the Treasury Board Secretariat and the Public Service Human Resources Management Agency of Canada (PSHRMAC) in their role as the management board of the Public Service of Canada by ensuring that the conduct of government affairs is in accordance with the law. 
  • It provides advice with respect to the statutes and regulations that apply to the Government of Canada. 
  • It provides specialized legal advice in connection with the Secretariat's and the PSHRMAC's central agency functions pertaining to the 21 statutes, and the regulations made pursuant to those statutes, for which the Treasury Board and the President of the Treasury Board, either alone or jointly with another Minister of the Crown, is responsible. 
  • It provides advice with respect to the enactment of and the amendment to legislation and regulations, as well as strategic advice concerning policy development and other initiatives. 
  • It conducts litigation before the Public Service Staff Relations Board and other administrative tribunals, the Federal Court - Trial Division, the Federal Court of Appeal and the Supreme Court of Canada in support of the employers of the Public Service of Canada.
