Introduction

This Application Guide facilitates an accurate understanding of Records Disposition Authority No. 2005/006 and the Terms and Conditions governing the selection and transfer of archival records to Library and Archives Canada (LAC). The Application Guide is a companion to the Terms and Conditions, not a replacement. The legal authority for the disposition of records remains with the MIDA 2005/006 and its Terms and Conditions. If there is a discrepancy between the Terms and Conditions and the Application Guide, the Terms and Conditions are always the basis for determining and interpreting the correct archival selection.

This Records Disposition Authority, also known as the Multi-Institutional Disposition Authority for Operational Case File Records (MIDA) No. 2005/006, and its Terms and Conditions, requires institutions to transfer operational case file records of archival value to Library and Archives Canada (LAC), and consents to the disposition of non-archival operational case file records at the end of their retention periods established for them by institutions.

MIDA No. 2005/006 consists of the:

i) Records Disposition Authority page signed by the Librarian and Archivist of Canada, and
ii) Terms and Conditions for the Transfer of Archival Operational Case File Records.

As a condition for using and applying this MIDA 2005/006, government institutions must agree to all Terms and Conditions of the Authority including the identification and transfer of archival records to the care and control of Library and Archives Canada. By applying this MIDA to its records, the institution thereby confirms its agreement with the Terms and Conditions.

During the implementation phase, from March 2007- March 2009, institutions will be required to inform LAC of how they intend to apply the MIDA to the case file records series in their holdings. Training will be provided in order to ensure the consistent and comprehensive application of the MIDA. Institutions will be required to identify and confirm which records series will be covered in conjunction with the LAC portfolio archivist.
