Signing the Canada–Hong Kong Foreign Investment Promotion and Protection Agreement (FIPA)
Background
Canada and Hong Kong began negotiations towards a Foreign Investment Promotion and Protection Agreement (FIPA) in September 2014. The parties pledged to work together to conclude an agreement in a timely manner. The conclusion of the negotiations was announced on May 23, 2015. The Agreement was signed by Canada’s Minister of International Trade, Chrystia Freeland, and Hong Kong’s Secretary for Commerce and Economic Development, Gregory So, on February 10, 2016, in Toronto, Ontario.
A bilateral FIPA will provide greater predictability and certainty for Canadian investors considering investment opportunities in Hong Kong. Canada’s objective in entering these negotiations is to secure a comprehensive, high-quality agreement which will protect investors through the establishment of a framework of legally binding rights and obligations.
