CKBY-FM Smiths Falls - Licence renewal

1.

The Commission received an application by Rogers Broadcasting Limited, to renew the broadcasting licence for the radio programming undertaking CKBY-FM (formerly CIOX-FM) Smiths Falls.

2.

The Commission received one intervention in connection with this application, submitted by Standard Radio Inc. (Standard), licensee of CKQB-FM Ottawa. Standard requested that the Commission require CKBY-FM to refrain from identifying itself as an Ottawa radio station. The licensee did not reply to the intervention.

3.

The Commission reminds the licensee that, consistent with the provisions set out in Letter Decision CRTC 2001-257, 4 May 2001 (Decision 2001-257), it continues to require the licensee to file bi-monthly reports (certified by the appropriate Chief Executive Officer or Chief Operating Officer) attesting to its compliance with the provisions set out in Decision 2001-257. These reports must continue to specifically indicate what programming broadcast on CKBY-FM Smiths Falls in fact originated in that city.

4.

Based on its examination of this application, the Commission renews the broadcasting licence for the radio programming undertaking CKBY-FM Smiths Falls, from 1 September 2004 to 31 August 2011. The licence will be subject to the conditions set out in New licence form for commercial radio stations, Public Notice CRTC 1999-137, 24 August 1999.

5.

Because this licensee is subject to the Employment Equity Act and files reports concerning employment equity with the Department of Human Resources and Skills Development, its employment equity practices are not examined by the Commission.
