Supreme Court of Prince Edward Island

The Supreme Court of Prince Edward Island is superior trial court of the province and is composed of four sections:

  • Estate Court exercises the jurisdiction vested in it under the Probate Act. It deals with wills, probate and the administration of estates

  • Family Court hears family law matters relating to divorce, custody and access, child support, division of property upon marriage breakdown and maintenance enforcement according to section 14 of the Judicature Act

  • Small Claims Court

  • General Court

Appealing a Supreme Court Decision

A party may appeal a decision of the Supreme Court of Prince Edward Island to the Prince Edward Island Court of Appeal.

The Judicature Act provides for a Chief Justice of the Supreme Court and at least four other judges. From time to time, there may also be part-time judges who are known as supernumerary judges. Supreme Court Judges may serve on the Prince Edward Island Court of Appeal as required.
