Suspension of the Party June to August 2018[edit]

On June 20 2018 Chief Electoral Officer of Elections Nova Scotia Richard Temporale suspended and threatened deregistration of the Atlantica Party Association of Nova Scotia for failure to file appropriate financial statements and for the Party’s breach of the Elections Act. The breaches arose due to money owed to former leader Jonathan Dean, as the Executive refused to repay the loan this placed Jonathan Dean and the Party in breach of the Elections Act in two places, sections 216(3)(a) and 216(3)(b) respectively. [7]

The money owed Jonathan Dean had accumulated over 10 years and was made up of incidental expenses paid by Jonathan Dean out-of-pocket for the Party’s benefit. It amounted to $8,811 and is labelled as a Promissory Note on page 3 in the public and Audited Financial Statements of December 31, 2017, and as reported to Elections NS. [8]Activity by persons on the Executive opened a criminal investigation into the Party by the Halifax Regional Police for attempted extortion. According to section 216(3)(a) of the Elections Act, Jonathan Dean could not forgive the loan as this would be considered a further donation exceeding the limit. [9]

The party suspension was extended on July 24, 2018 due to failure to resolve the breaches. [10]

On July 31and August 7 respectively Mr. Dean and the Party entered into a Compliance Agreement with Elections NS. [11] [12]

With resolution of the loan issue the suspension of the Party was lifted on August 16, 2018. [13]
