MEMORANDUM OF AGREEMENT
BETWEEN
THE TREASURY BOARD
AND
THE PROFESSIONAL INSTITUTE OF THE PUBLIC SERVICE OF CANADA
IN RESPECT OF THE RE-OPENING OF THE
COLLECTIVE AGREEMENT FOR THE
LAW BARGAINING UNIT

Effective September 13, 2002/Expiration February 28, 2004

The representatives of the Treasury Board and the Professional Institute of the Public Service of Canada, in accordance with Article 29 of the Law Group (LA) Collective Agreement, agree to re-open and amend the collective agreement applicable to the Law bargaining unit. The existing "Appendix A - Law Group Annual Rates of Pay is hereby replaced by the amended provisions attached to this Memorandum of Agreement.

NOTES:

PAY INCREMENT ADMINISTRATION

(1) The pay increment shall be to the next higher rate in the scale of rates.

(2) The pay increment period for employees paid in the LA-1 scale is six (6) months.

(3) The pay increment period is twelve (12) months for employees paid in the LA-2(I) and LA-2(II) scales.

(4) Part-Time Employees

A part-time employee shall be entitled to receive a pay increment when the employee has worked a total of:

(a) nine hundred and seventy-five (975) straight-time hours for LA-1 employees;

or

(b) nineteen hundred and fifty (1,950) straight-time hours for LA-2(I) and LA-2(II) employees.

PAY ADJUSTMENT ADMINISTRATION

Effective March 1, 2001, an employee shall be paid in the "A" scale of rates at the rate of pay which is immediately below the employee's rate in the "From" scale of rates.

Effective March 1, 2002, an employee shall be paid in the "B" scale of rates at the rate of pay which is immediately below the employee's rate in the "X" scale of rates.

Effective March 1, 2003, an employee shall be paid in the "C" scale of rates at the rate of pay which is immediately below the employee's rate in the "B" scale of rates.

**

1. Restructure Administration

(a) All employees at levels LA-1 or LA-2 (I) or LA-2 (II) for whom a pay adjustment is effective April 1, 2001 shall be paid in the "X" scale of rates of pay which is immediately below the employee's rate of pay at the "A" scale of rates shown in Appendix "A" or at the closest rate, but not lower than the employee's former rate of pay.

(b) All employees at level LA-1 whose rate of pay changes as a result of Restructure Administration Note 1a) shall retain their pay increment date established prior to the pay rate change.

(c) All employees being paid in the LA-1 or LA-2 (I) or LA-2 (II) who have been at the maximum rate of pay for their level for twelve (12) months or more on April 1st, 2001, will move to the new maximum rate of pay effective April 1st, 2001.

(d) Where an employee is performing acting duties on April 1st, 2001, and is paid acting pay pursuant to clause 15.04, the employee's acting rate of pay will be adjusted effective April 1st, 2001, in accordance with Restructure Administration Note 1a). Upon termination of the acting assignment, the employee's substantive rate of pay will then be adjusted in accordance with Restructure Administration Note 1a).
