MEMORANDUM OF UNDERSTANDING
BETWEEN
THE TREASURY BOARD OF CANADA
AND
THE PROFESSIONAL INSTITUTE
OF THE
PUBLIC SERVICE OF CANADA (PIPSC)
IN RESPECT OF THE
NEGOTIATION OF WORK FORCE ADJUSTMENT PROVISIONS

Effective March 4, 2005/Expiration September 30, 2006

1. The Parties hereby agree that the negotiation for the renewal of the Work Force Adjustment (WFA) provisions applicable to all PIPSC bargaining units has been concluded centrally at a common bargaining table. The Parties agree that the WFA provisions shall not be subject to further negotiations during the current round of collective bargaining for the PIPSC bargaining units.

2. The WFA provisions negotiated at the common table shall become binding upon the Parties and take effect on the date of signing of this memorandum. The implementation of the newly negotiated WFA provisions shall apply to all PIPSC bargaining units (AV, AP, CS, LA, RE, SH).

3. The parties agree not to present any changes to the WFA provisions prior to 30 September 2006, unless otherwise mutually agreed.

4. Three months prior to 30 September 2006, the parties shall initiate discussions and sign a memorandum of agreement establishing the parameters of the next common table negotiation, as well as the implementation process of the changes that will result from the next WFA negotiation.

5. Attached is the list of the agreed upon changes to the PIPSC WFA provisions. The following specific group appendixes are accordingly amended:

Applied Sciences and Engineering Appendix K (Sept. 30, 2005)
Computer Systems Appendix F (Terms and Conditions of Employment)
Audit, Commerce and Purchasing Appendix B (Terms and Conditions of Employment)
Health Services Appendix S (Terms and Conditions of Employment)
Law Appendix B (Collective Agreement - Feb. 28, 2006)
Research Appendix C (Collective Agreement - Sept. 30, 2006)
